Contracts of employment in Poland

Contracts of employment may have an indefinite or fixed duration. Furthermore, trial periods of up to three months may be written into the contract.

What is the policy for maternity leave?

Maternity leave for a mother to have her first child is 18 weeks, and then 20 for any children thereafter. It is 26 weeks in the case of a multiple pregnancy. Maternity allowance is worked out as equal to the average remuneration from the last six months of work preceding the child’s birth.

What is Polish law about termination of employment?

Polish employment law requires all dismissals to be in writing and for a valid reason, and specifies several grounds of lawful and unlawful dismissal.Valid reasons include misconduct, employee incapacity or financial, structural reasons within the company. In the case of serious misconduct, the employer has the right to dismiss without notice. Instances of serious misconduct include disturbing the peace of the workplace, being absent without justification, and drunk at the workplace. The worker may also be summarily dismissed if he or she is convicted of a criminal or civil offence, which makes further employment impossible. 

How much notice is required in Poland?

Notice is required with regard to termination of an indefinite period contract or a trial period contract.The length of notice depends on the length of the period of employment, as follows: 
  • Two weeks notice for an employment of less than six months;
  • One month for an employment of above six months;
  • Three months for an employment of at least three years.
Where a contract of employment was concluded for a fixed term longer than six months, the parties to the contract may provide for an “early termination” notice period of two weeks.Source: InternationalLabourOrganization.org
